The customer acknowledges and agrees that the Platform is not the ultimate bearer of insured risk and is not the direct underwriter of the insurance coverage. Unless otherwise expressly provided by applicable law or by an arrangement with the insurer that is legally binding on the customer, the insurer or underwriting entity shall remain the ultimate party responsible for underwriting obligations, coverage obligations, policy administration, and obligations relating to the validity and performance of the insurance contract.
If the customer has made payment through the Platform but, due to the Platform’s operational failure, delayed remittance, system malfunction, settlement delay, insolvency, cessation of business, bankruptcy, or any other reason, the premium is not remitted to the insurer on time or in full, then, to the extent that applicable law, insurer regulatory obligations, or the effective contractual arrangements between the insurer and the Platform require the insurer to bear direct responsibility in respect of the policy, the customer shall pursue any claim relating to policy confirmation, insurance coverage, underwriting responsibility, or contractual performance directly against the relevant insurer or underwriting entity. Such responsibility shall not be borne by any third-party payment processor, acquiring institution, payment gateway, bank, or settlement service provider.
Any third-party payment processor, acquirer, payment gateway, bank, or settlement service provider connected to the Platform provides payment processing, acquiring, settlement, or technical services only, and does not participate in underwriting, policy issuance, policy administration, or performance of insurance obligations. The customer shall not assert that such payment service providers are liable for underwriting obligations, coverage obligations, or insurance-related compensation solely by reason of any dispute concerning the insurance policy, policy status, or remittance of premiums to the insurer.
Nothing in this clause shall limit or exclude any mandatory statutory rights of the customer under applicable law.
If any provision of this Agreement is found to be invalid, void, or unenforceable for any reason, the parties agree that the court or competent authority shall, to the extent possible, give effect to the parties’ intentions as reflected in such provision, and such unenforceable provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions. Headings are for reference purposes only and do not limit the scope or effect of the relevant sections.
